DATA PRIVACY AND PROCESSING CONSENT FORM

 

For Students and Parents/Guardians (Kuwait & Bahrain)

1. Introduction

By enrolling with Aakash Educational Services Limited ("AESL"), you agree to the collection, processing, and transfer of your/your ward's personal data across our digital learning platforms (myAakash, Vyom, AakashGuru, and Crystal). This consent form outlines the data we collect, how it is used, and requires your explicit authorization to process this data in compliance with applicable local data protection regulations.

2. AESL's Privacy Promises

We understand the importance of your privacy and are deeply committed to safeguarding it. AESL expressly promises and commits to the following:

• We will never sell, lease, or trade your/your ward's personal data to external third parties for their independent commercial or marketing use.

• Access to personal and academic data is strictly limited to authorized AESL personnel, educators, and verified service providers on a "need-to-know" basis.

• We deploy robust, industry-standard cybersecurity measures and encryption protocols to safeguard your data against unauthorized access, alteration, or loss.

• We collect and process only the information that is strictly necessary to deliver, support, and enhance our educational services.

3. Categories of Data Collected

We collect and process the following categories of personal data across our platforms:

• Identity and Contact Information: Student Name, Mobile Number, Student Email ID, Parent Email ID, Date of Birth, and Gender. (Note: Student names will be masked during live sessions for privacy).

• Academic and Performance Data: Class, Stream, Academic Term, Language, Student ID/Roll No., Batch, Centre, Subjects, Test scores, AI-evaluated outputs, Schedule, Attendance, and Counselling interaction records.

• Live Classroom Data: Audio and video streams during live classes, chat logs, Q&A submissions, poll responses, hand raises, emoji reactions, and general engagement/attentiveness metrics.

• Technical and Device Data: Operating System, Device Type, Device Brand and Model, Browser type, Screen Resolution, Connection quality, and Session logs.

• Location Data: Country, State, City, Locality, and Postal Code.

4. Purpose of Processing

Your data is processed strictly for the following purposes:
• Delivering academic content, live classes, and assessments.
• Tracking academic progress, providing student counselling, and sending academic alerts.
• Evaluating platform performance and diagnosing technical issues.
• Analyzing user behavior to improve product experience and customer engagement.

5. Third-Party Analytics and Data Sharing

To improve our services, AESL utilizes third-party Product Analytics and Customer Engagement tools, specifically Google Analytics and Webengage. Technical, location, demographic, and device data is securely shared with these processors.

6. Cross-Border Data Transfer

As AESL is headquartered in India, the personal data collected will be transferred to, stored, and processed on servers located in India. AESL implements appropriate technical and organizational security measures to ensure that your data is protected against unauthorized access, loss, or misuse during and after this transfer. By signing this form, you explicitly consent to the cross-border transfer of your/your ward's data outside of Kuwait/Bahrain to India.

7. Service Communications (OTP, Verification, Calls, Email & WhatsApp)

You authorize AESL to use your provided mobile number and email ID to communicate via phone calls, SMS, WhatsApp, and Email for essential service-related and transactional purposes. This includes sending One-Time Passwords (OTPs), account verification codes, login authentication alerts, class schedule updates, technical support, fee reminders, and academic performance reports.

8. Audio and Video Recording of Live Sessions

Our live classroom platform (Crystal) allows for the recording of educational sessions for review and quality assurance purposes. These recordings may capture your/your ward's audio, video, and interactions.

9. Consent Withdrawal

You have the right to withdraw your consent for optional data processing (such as marketing communications) at any time. Withdrawal requests or privacy-related queries can be submitted to our Data Protection Officer at dpo@aesl.in

Please note that withdrawing consent for Part A (Mandatory Consents & Service Communications) will render AESL unable to provide the educational services, and will result in the suspension or termination of access.

10. Your Data Privacy Rights

Under applicable data protection laws, you possess the right to:

• Request access to the personal data AESL holds about you/your ward.

• Request correction of any inaccurate or incomplete data.

• Request the erasure of personal data (subject to AESL’s legal and operational retention requirements).

• Object to or restrict the processing of your data for specific purposes. To exercise these rights, please contact our Data Protection Officer at dpo@aesl.in.

11. Data Retention

AESL will retain your/your ward's personal data only for as long as necessary to fulfill the educational purposes outlined in this consent form, or as required to comply with applicable legal, accounting, or regulatory obligations. Once the retention period expires, data will be securely deleted or anonymized.

12. Governing Language

This consent form is drafted in English. In the event this form is translated into Arabic or any other language, the English version shall prevail in case of any discrepancy or conflict in interpretation.

PART A: MANDATORY CONSENTS & SERVICE COMMUNICATIONS (Required to access and secure AESL digital learning platforms)

[ ] General Processing & Educational Delivery: I have read and agree to the [Terms & Conditions] and [Privacy Policy]. I consent to the processing of my/my ward's personal and academic data across myAakash, Vyom, AakashGuru, and Crystal for educational purposes in accordance with AESL's privacy promises.

[ ] Cross-Border Transfer: I explicitly consent to the transfer and processing of my/my ward's personal data to AESL's servers located in India.

[ ] Service Communications (OTP, Verification, Calls, Email & WhatsApp): I consent to receiving essential service-related communications, account verifications, OTPs transactional updates, operational phone calls, emails, and WhatsApp messages necessary for managing my enrollment and platform access.

[ ] Analytics and Tracking: I consent to the collection of device, location, and behavioral data, and the sharing of this data with third-party tools (Google Analytics and Webengage) for product enhancement.

[ ] Live Class Recordings: I consent to the recording of audio, video, and platform interactions during live classes on the Crystal platform, understanding that these recordings are used strictly for educational and quality purposes.

[ ] Parental/Guardian Consent (For Minors): I confirm that I am the legal parent or guardian of the student named below, and I grant permission for AESL to collect and process their data as outlined above.

PART B: OPTIONAL CONSENTS (Not required to access learning platforms; you may opt-in based on your preference)

[ ] Marketing & Promotional Communications (Call, SMS, Email & WhatsApp): I consent to receiving promotional offers, course announcements, newsletters, marketing calls, SMS updates, and promotional WhatsApp messages from AESL.

[ ] Publicity and Testimonials: I grant AESL permission to use my/my ward's name, photograph, video, academic results, and testimonials for promotional purposes, including social media, websites, print advertisements, and brochures to celebrate academic achievements.
